TERMS AND CONDITIONS FOR ONLINE SALE OF GOODS
Contracting Entity
The Benromach Distillery website is operated by Benromach Distillery Co Limited, a subsidiary company of Speymalt Whisky Distributors Ltd t/a Gordon & MacPhail.
These terms and conditions form the basis of a contract of sale between Gordon and MacPhail and you as the customer.
Using our website and buying our products
When you place an order or make payment through the website you agree to our terms of sale set out here. We only ship our products to customers located within the territories noted below. We also sell and deliver only to people over the age of 18.
When you order from us, you confirm to us that you are at least 18 years old, the recipient is at least 18 years old and the recipient lives within the territories noted below.
Territories: We ship our products to customers located in the UK only.

Processing your order
You will receive an order confirmation after placing your order. You will also receive a despatch confirmation from us (or our third-party couriers) when the product is despatched to you.
You will usually be charged when you place your order
If that will not be the case, we will let you know
Products can vary slightly from their pictures
A product's true colour may not exactly match that shown online or in a catalogue and its packaging may be slightly different.
Changing your mind
If you bought online you have a legal right to change your mind about your purchase and receive a refund of what you paid for it, including the delivery costs. This is subject to some conditions, as set out below.
When you can't change your mind. You can't change your mind about an order for:
- goods that are made to your specifications or are clearly personalised;
- goods that have been partially consumed; and
- goods which become mixed inseparably with other items after their delivery.
The deadline for changing your mind. If you change your mind about a product, you must let us know no later than 14 days after the day we deliver it. If your purchase is split into several deliveries over different days, the period runs from the day after the last delivery.

You have to return the product at your own cost. You have to return your product to us within 14 days of your telling us you have changed your mind. We do not accept in-person returns. Returns are at your own cost and risk, unless we offered free returns when you bought the product. You can send the product back to us by recorded post or using an established delivery service. If you do this, you should keep a receipt or other evidence from the delivery service that proves you have sent it and when you sent it. We recommend you package your return in the same packaging it was provided, or if no longer available, suitably packaged and protected for the nature of the product (i.e. glass bottle). If you don’t do this and we don’t receive the goods at all, damaged or within a reasonable time we may not be able to refund the price. We are not liable for your return delivery fees and/or costs unless we are satisfied that the product was faulty.
We will reduce your refund if you have used or damaged a product. If you have handled the product in an unacceptable way, we reduce your refund, to compensate us for its reduced value. For example, we reduce your refund if e.g. the product's condition is not "as new”, or the packaging is damaged. In some cases, because of the way you have treated the product, no refund may be due.
When and how we refund you. If you tell us you've changed your mind about a product that hasn't been delivered, we refund you as soon as possible and within 14 days. If you're sending your product back to us, we refund you within 14 days of receiving it (or receiving evidence you've sent it to us). We refund you by the method you used for payment. We don't charge a fee for the refund.
You have rights if there is something wrong with your product

We honour our legal duty to provide you with products that are as described to you on our website and that meet all the requirements imposed by law.
We may change our products or terms
We can always change a product to reflect changes in relevant laws and regulatory requirements or to make minor technical adjustments and improvements, and we may stop providing certain products from time to time.
When we deliver to you
When the products are being delivered to you or the address you have specified, you or the person looking to receive the products may be asked for proof of ID and age. We and our third-party delivery partners reserve the right not to deliver the Product in the event that insufficient ID or proof of age is provided.

Out of stock Items, restrictions and errors
Sometimes we may not be able to fulfil orders because a product is unexpectedly out of stock, because we can't verify your age, because you or the recipient is located outside of our delivery areas, or because the product was mispriced by us. When this happens, we let you know as soon as possible and refund any sums you have paid.

Other terms
We can transfer our contract with you, so that a different organisation is responsible for supplying your product.
You can only transfer your contract with us to someone else if we agree to this.
This contract is between you and us. Nobody else can enforce it.
If a court or other authority decides that some of these terms are unlawful, the rest will continue to apply.
Even if we delay in enforcing this contract, we can still enforce it later.
You irrevocably agree that the courts of Scotland shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these terms and conditions or its subject matter or formation.
